1. Introduction

These Terms and Conditions (“Terms”) govern your use of the Lucky Trails mobile application (“App”), website https://luckytrails.ie/ (“Website”), and your participation in any outdoor escape room experiences (“Experiences”) provided, which is operated by Anastasiia Voloshchuk, sole trader registered in Ireland. By accessing or using the App or Website, you agree to be bound by these Terms.

Lucky Trails offers a mobile app that delivers location-based outdoor escape room games. Each Experience typically lasts between 2 and 2.5 hours, though users may pause and resume at their convenience. Experiences are designed to be completed by observing public surroundings - no special knowledge, tools, or equipment are required.

4. Use of Our Services

Eligibility

You must be at least 16 years old to create and manage an account independently. If you are under 16, you may use the App and participate in an Experience only with the consent and supervision of a parent or guardian.

Our Website is intended for general informational purposes and does not require age-based restrictions. However, we do not knowingly collect personal data from users under the age of 16 without verified parental consent. If you believe a child has provided us with personal data via any channel, please contact us.

Account Registration

To access certain features and track progress, you may be required to log in using Apple or Google authentication. You are responsible for maintaining the security of your account and ensuring that your login details are not shared with others.

Account and Data Management

You may delete your account at any time via the App. Upon deletion, associated personal data will be removed in accordance with our Privacy Policy and applicable law.

Privacy and Data Protection

We collect and process data in accordance with the General Data Protection Regulation (GDPR) and applicable Irish data protection laws.

Our Privacy Policy explains how we collect, use, and protect your personal data. By using the App or Website, you agree to our Privacy Policy.

We do not store passwords or payment details, as these are handled by Apple and Google. Location data is only collected with your consent and used to enhance gameplay.

We do not knowingly collect personal data from users under the age of 16 without verified parental consent. If we become aware that such data has been collected inadvertently, we will delete it promptly.

5. Payments and Refunds

In-App Purchases

All purchases are processed through Google Play Store or Apple App Store, depending on your device. We do not process or store payment details. Prices are displayed in Euro and may be subject to applicable taxes. By making a purchase, you agree to the pricing, terms, and policies of the respective app store. Refunds and Cancellations

Refunds are subject to the policies of the platform where the purchase was made (Google Play or App Store). Lucky Trails does not process direct refunds. Users who experience issues may contact us at luckytrails.ie@gmail.com for assistance.

Consumers may have statutory cancellation or withdrawal rights under applicable law. Purchases, cancellations and refund requests are processed by the Apple App Store or Google Play Store and are subject to the applicable platform’s terms and refund procedures. Nothing in these Terms limits any mandatory consumer rights.

If a refund is issued, access to the associated digital content, such as a purchased trail, may be revoked by Lucky Trails or the relevant app-store platform.

6. User Obligations

Our outdoor puzzle quests take place in real-world locations. While we aim to design them with safety in mind, you are responsible for your own safety while participating.

If you are playing as part of a team using the same device, all participants are expected to follow safety guidelines, local laws, regulations, and respect public spaces.

You agree to remain aware of your surroundings and avoid any unsafe behaviour (e.g., entering restricted areas or crossing roads unsafely). Do not trespass on private property or disrupt public areas during gameplay. Do not damage public or private property. Please play responsibly and prioritise safety.

Lucky Trails is not liable for any injuries, damages, or accidents that may occur while using the App.

Ensure that necessary device permissions (e.g., camera or location access) are enabled to fully enjoy all gameplay features.

7. Intellectual Property

All content within the App and Website, including but not limited to quests, puzzles, text, images, logos, trademarks, and software is the exclusive property of Lucky Trails or its licensors. You may not copy, modify, distribute, reproduce, or create derivative works based on any part of our content without prior written permission from us. Unauthorised use of our intellectual property may result in legal action.

8. Liability and Disclaimers

No Guarantees

We provide the App “as is” and “as available” without warranties of any kind. While we strive for accuracy, we do not guarantee that all puzzles, clues, or locations will be error-free.

We are not responsible for failures or delays caused by third-party services such as Maps, GPS accuracy, mobile data providers, or app store platforms.

Nothing in these Terms affects any statutory rights or remedies available to consumers under applicable law.

Limitation of Liability

To the fullest extent permitted by law, Lucky Trails will not be liable for indirect, incidental, or consequential losses arising from use of the App, or for delays or interruptions caused by technical issues, weather, third parties, or circumstances beyond our reasonable control, including natural disasters, strikes, or regulatory restrictions.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing in these Terms limits your mandatory rights or remedies under applicable consumer law.

Participation is at your own risk.

Shared Device and Team Participation

If multiple people are participating in a quest using the same device, the registered account holder is responsible for ensuring all teammates comply with these Terms. All participants must acknowledge that gameplay involves real-world locations and agree to follow safety guidelines and local laws. We are not responsible for any actions taken by teammates or additional players using the same device.

9. User-Generated Content

Content Sharing

If you submit photos, videos, feedback or reviews, you grant us a non-exclusive, worldwide royalty-free license to use, display, and share them for marketing purposes (e.g., social media, website promotions or in-App features). You retain ownership of your content, but allow us to use and distribute it in relation to our Services.

Content Guidelines

You must have the legal right to share any content you upload. We reserve the right to remove any content that is offensive, inappropriate, or violates these Terms or applicable laws.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or misuse the App. We may also modify or discontinue parts of the App at any time.

Termination may result in loss of access to purchased content or in-progress quests, as outlined in the Refunds and Cancellations section.

11. Governing Law and Disputes

These Terms are governed by the laws of Ireland. If you are a consumer, you also retain the benefit of any mandatory protections provided by the laws of your country of residence. Any dispute may be brought before the courts having jurisdiction under applicable law.

12. Changes to Terms

We may update these Terms from time to time. Updates will take effect upon publication in the App or on our website, with the revised “Last Updated” date. If changes are significant, we will notify you via the App or email. Continued use of the App after changes indicates your acceptance of the updated Terms.
